1. Acceptance of Terms

By accessing or using LevelUp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all the terms, you may not access or use the Service. LevelUp is operated by Aligna (Pty) Ltd.

2. Description of Service

LevelUp is an AI-powered social media content generation platform that provides the following capabilities:

  • AI-driven script writing and content generation
  • AI video generation using avatar and text-to-speech technology
  • Multi-platform social media publishing
  • Content scheduling and calendar management
  • Analytics and performance insights

The Service is provided on a subscription basis with different tier levels. Features and limitations vary by plan.

3. User Obligations

As a user of LevelUp, you agree to:

  • Provide accurate and complete registration information
  • Maintain the confidentiality of your account credentials
  • Use the Service in compliance with all applicable laws and regulations
  • Not use the Service to generate, publish, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Not attempt to reverse-engineer, hack, or disrupt the Service
  • Not use the Service to infringe upon the intellectual property rights of others
  • Not upload malicious code or attempt to compromise the platform's security

4. Intellectual Property

Your Content: You retain all rights to the scripts, campaign configurations, and content you create using LevelUp. By using the Service, you grant Aligna a limited license to process your content solely for the purpose of providing the Service.

AI-Generated Content: Content generated by the AI, including scripts and videos, is owned by you. However, the underlying AI models, algorithms, and technology remain the intellectual property of Aligna and/or its licensors.

Service IP: The LevelUp name, logo, platform code, and branding are the exclusive property of Aligna. You may not use them without prior written consent.

Feedback: Any suggestions, ideas, or feedback you provide may be used by Aligna to improve the Service without compensation or attribution.

5. Subscription and Billing

Paid subscriptions are billed monthly or annually as selected at signup. Fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Price changes do not affect your current billing cycle.

6. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind, either express or implied
  • Aligna shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • We are not responsible for content generated by AI that may be inaccurate, inappropriate, or non-compliant with platform policies
  • We are not liable for content published to third-party platforms or for actions taken by those platforms regarding your content

7. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control. We are not liable for any loss resulting from service interruptions.

8. Third-Party Services

LevelUp integrates with third-party services including OpenAI, HeyGen, YouTube, TikTok, Instagram, and Facebook. Your use of these services is subject to their respective terms and policies. Aligna is not responsible for the operation or availability of third-party services.

9. Termination

We may terminate or suspend your account for violation of these terms, illegal activity, or at our discretion with notice. Upon termination, your access to the Service will cease. You may terminate your account at any time. Content generated prior to termination remains yours.

10. Indemnification

You agree to indemnify and hold Aligna harmless from any claims, damages, or expenses arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

11. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.
